Terms of Use - Vinylcore

These Terms of Use ("Terms") govern your use of the Vinylcore mobile application (the "App"), provided by The Mystery Guest Web Design ("we", "us", "our"). By downloading, installing, or using the App you agree to these Terms. If you do not agree, please do not use the App.
1. What Vinylcore Does
Vinylcore lets you play audio at altered speeds and pitches — simulating a record played at the wrong RPM. It can play audio from:
- Songs you have purchased from iTunes or synced to your device from a computer
- Internet radio stations (HLS and ICY streams)
- Podcasts via public RSS feeds
- Jamendo (Creative Commons–licensed music)
- Archive.org public audio
- Direct HTTP(S) audio URLs you provide
2. Sources That Are NOT Supported
Vinylcore does not and cannot play audio from closed or DRM-protected streaming services. This is a technical and licensing limitation, not a feature we plan to add. Unsupported services include (but are not limited to):
- Apple Music and iCloud Music Library – tracks are DRM-protected.
- Spotify – Spotify's SDK does not provide raw audio to third-party apps.
- YouTube and YouTube Music – extracting audio violates YouTube's Terms of Service and Apple's App Store guidelines.
- Tidal, Deezer, Amazon Music, and other closed streaming platforms.
If a song or podcast you want to play is only available through one of these services, Vinylcore will not be able to open it. We are unable to offer support, refunds, or workarounds for this.
3. Acceptable Use
You agree that you will:
- Only use the App to play audio you have the legal right to play.
- Not use the App to violate any copyright, intellectual property, or other third-party rights.
- Not attempt to bypass technical protection on DRM-protected content using the App.
- Not reverse engineer, decompile, or attempt to extract source code from the App, except as permitted by law.
- Not use the App to harass, harm, or infringe on the rights of others.
4. Third-Party Content
Vinylcore can stream audio from third-party sources (such as internet radio stations, podcasts, Jamendo, and Archive.org). We do not host, control, or endorse any of that content. We make no warranty that any particular stream will be available, lawful in your jurisdiction, accurate, or suitable for any purpose.
Use of third-party streams is governed by the terms and policies of the relevant provider. You are responsible for ensuring that your use of any stream complies with those terms, with copyright law, and with the laws of your country.
If you believe content surfaced inside the App infringes your rights, please contact us using the details below and we will investigate.
5. Purchases and Restoring
Vinylcore offers optional one-time in-app purchases to unlock features such as ad-free playback, full-track playback (instead of the 15-second free preview), and unlimited playlists. There is no subscription and you will not be billed on a recurring basis. Purchases are processed by Apple (App Store) or Google (Play Store) and are subject to their respective terms.
If you previously purchased a paid version of the App, or are using the App on a new device, use the "Restore Purchases" option inside the App while signed in with the same Apple ID or Google account to restore your entitlements.
Refunds are handled by the App Store and Play Store under their respective refund policies. We are not able to issue refunds directly.
6. Advertising
The free version of the App displays advertising via Google AdMob. Ads may be served based on coarse, non-personal device information. You can opt out of personalised advertising via your device's privacy settings, or remove ads entirely by purchasing the ad-free upgrade.
7. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability of any third-party stream.
Format and compatibility: we endeavour to support as many audio formats, codecs, container types and streaming protocols as we reasonably can, but we cannot guarantee that every file, URL or stream will play. Some audio sources use unusual codecs, non-standard container formats, broken or redirecting URLs, malformed streams, server-side authentication, geo-restrictions, or other technical quirks that put them beyond what Vinylcore (or the underlying audio engine on your device) is able to handle. This is especially likely for HTTP(S) URLs you paste in yourself, obscure podcast feeds, and older Archive.org material. If a particular item won't play, it does not necessarily indicate a fault in the App.
Playback at altered speeds and pitches is intended as a creative listening experience. Playing audio (and especially radio or podcasts) at non-standard speeds may make speech less intelligible — please use your judgement, particularly for safety-critical content like emergency broadcasts.
8. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with your use of the App — including any inability to play content from any particular source.
Nothing in these Terms excludes or limits any rights you have under applicable consumer law (including, in Australia, the Australian Consumer Law) that cannot lawfully be excluded.
9. Changes to These Terms
We may update these Terms from time to time. The current version will always be available at this URL, with an updated "Last Updated" date. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of Australia. To the extent permitted by law, any dispute relating to the App or these Terms will be subject to the non-exclusive jurisdiction of the courts of Australia.
